Intellectual Property Policy
Last updated:
Personalized gifts sit at a busy crossroads of rights: our own designs and brand, the artwork and logos that belong to other people, and the names and photos our customers send us. This Intellectual Property Policy explains what belongs to Gift Nook, what you may and may not do with it, how we respect other people’s rights when we print your gifts, and how to report a concern. Copyright takedown notices under the DMCA have their own step-by-step page: DMCA.
Intellectual property in short
- Ours: the Gift Nook name and logo, our product designs, site graphics and written content.
- Fine to do: link to our pages, share a product with a friend, show off a gift you bought.
- Not fine: copying our designs, photos or text to sell products, or using our name in a way that implies endorsement.
- Your content: names, text and photos you send are used only to make your gift; photos are deleted 30 days after delivery.
- Report a concern: support@giftnook.shop, subject “IP concern”.
1. What Gift Nook owns
Unless stated otherwise, the following belong to Gift Nook or are used by us with permission:
- the name “Gift Nook” and our logo, the gift box inside an arched nook;
- our product designs: layouts, lettering arrangements, decorative borders and illustrations used on suncatchers, ornaments, tumblers, shirts and keepsakes;
- product and lifestyle photographs and site graphics;
- the written content of the site, including product descriptions, category guides, help pages and policies;
- the overall look of the site, including its arrangement of sections such as the gift finder.
2. What you may do
- Browse the site, and print or save pages for your own personal reference, such as keeping a copy of our return policy.
- Share links to our product and category pages on social media, in messages or on your own site.
- Post photos of a gift you bought from us, including the design, in a personal context such as a birthday post.
- Quote short parts of our policies when discussing them, with a link back to the page.
3. What you may not do
- Copy, trace or recreate our product designs to make or sell products, including print-on-demand listings on other marketplaces.
- Use our product photos or written descriptions on another store or listing.
- Use the Gift Nook name or logo in a business name, domain, social account or advertisement in a way that could make people think you are us or are endorsed by us.
- Scrape the site at scale, or reproduce substantial parts of it, such as entire help pages or policy pages, for commercial purposes.
- Remove copyright or ownership notices from anything you download from the site.
If you would like to use our content in a way not covered here, such as a feature in a gift guide or a magazine, email us. We are usually happy to help, and we will tell you which images you may use and how to credit them.
4. The Gift Nook name and logo
Our name and logo identify our shop and our products. Please do not alter the logo, combine it with your own marks, or use it on products. If you are writing a gift guide or review and want to mention us, using our name in plain text with a link is always fine.
5. Respecting other people’s rights when we print
Many gift requests are about things people love: a sports team, a favorite cartoon, a band, a brand. Those are usually protected by trademark or copyright, and we cannot print them without the owner’s permission. When a customer’s order notes or photo include protected marks or artwork, we contact the customer to agree an alternative, such as team colors and the person’s name instead of a logo, or we cancel the order and refund it in full.
| Request | Can we print it? | What we suggest |
|---|---|---|
| A name, nickname, date or short message you wrote | Yes | Type it exactly as it should appear |
| A family photo you took | Yes | Email it after ordering; it is deleted 30 days after delivery |
| A professional photo, such as wedding photos | Usually, for personal gifts, if you have the photographer’s permission | Check your photography agreement |
| A sports team logo or league mark | No | Team colors with the person’s name or number |
| Cartoon or film characters | No | One of our own illustrations or a theme in words |
| Song lyrics or published poems | Not long passages | Your own words, or a very short line you wrote |
| A business logo for a company gift | Only if you own it or are authorized | Confirm authorization in your order notes |
6. Your content
The names, text and photos you send stay yours. By sending them you give us permission to use them only to produce, ship and support your order. We do not use customer photos or personalization in our marketing, product photos or social media. We delete customer photos 30 days after the order is delivered, as explained in our Privacy Policy. If we ever wanted to feature a customer’s gift, we would ask first and only proceed with clear written permission.
You confirm that you have the right to use what you send us, for example that a photo is yours or that you have permission to use it, and that it does not infringe anyone else’s rights.
7. How to report an intellectual property concern
If you believe something on giftnook.shop uses your trademark, artwork or other intellectual property without permission, email support@giftnook.shop with “IP concern” in the subject line, or write to Gift Nook, 5201 Georgia Ave, West Palm Beach, FL 33405, US. Please include:
- your name and contact details, and your relationship to the rights owner if you are acting for them;
- a description of the right involved (for example a registered trademark and its registration number, or an original artwork with a link to it);
- the URL of the page on our site and which item or image concerns you;
- a short explanation of why you believe it infringes, and what outcome you are asking for.
For copyright specifically, a notice that meets the DMCA requirements lets us act fastest; the elements are listed on our DMCA page.
8. What happens next
We acknowledge your message within 24 hours on business days. We then review the concern, which may involve looking at where a design came from and asking you for more information. If we agree there is a problem, we remove or change the content and tell you what we did. If we do not agree, we explain why, and you remain free to pursue any other remedies you have. We keep a record of concerns so that repeat problems are dealt with consistently.
9. Ideas and feedback
Customers often suggest new gift ideas, such as a suncatcher for a new pet or an ornament for a first apartment. We love hearing them. If you send us a product idea or feedback, you agree that we may use it to improve our shop without owing you payment, and we will not claim ownership of anything you already own, such as your own artwork or photos.
10. A worked example
A customer orders a tumbler for her son and writes the name of his favorite basketball team and its logo in the order notes. Before printing, we email her: we cannot print the team’s logo or trademarked name, but we can print his name, his jersey number and the team’s colors in our own design. She agrees, we update the order within her 24-hour change window, and the tumbler is printed with his name and number. If she had preferred not to change the design, we would have cancelled and refunded the order in full.
Frequently asked questions about intellectual property
I bought a gift from you. Can I post a picture of it online?
Yes. Personal posts showing a gift you bought or received are welcome, and you do not need to ask us. Please do not present our design as your own work or use the picture to sell copies.
Can I resell a Gift Nook item?
You may resell an individual item you bought, the way you would sell any second-hand gift. You may not reproduce our designs to sell new products.
I am a designer. Can I submit artwork to be sold on Gift Nook?
We do not currently take open submissions. You are welcome to email us a link to your portfolio; if we ever work with outside designers, we would agree terms in writing first.
Can you print my company’s logo on gifts for my team?
Yes, if the logo belongs to your company and you are authorized to use it. Mention it in the order notes and email the logo file after ordering. We may ask you to confirm the authorization.
Can I use a quote from a famous person?
Short, widely known quotations are often fine, but some phrases are registered as trademarks and song lyrics are usually protected. If in doubt, choose words of your own, which also make the gift more personal.
What if a photo shows another person?
Family photos are the heart of many gifts. Please make sure the people shown would be happy to see the photo on a gift. We will not print photos intended to embarrass or target someone.
Our own designs on other sites
If you find a Gift Nook design, photo or description on another store, we would be grateful if you told us. Email the link to support@giftnook.shop. We cannot always act on every report, but they help us protect the shop and the people who buy from it.
Why this matters for gift buyers
Respecting intellectual property protects you as well as rights owners. A gift printed with an unlicensed logo can be seized at a border, refused by a carrier or simply look poor because it was copied from a low-resolution image. Designs built from your own words, your own photos and our original artwork avoid those problems and are more personal too, which is the whole point of a gift from Gift Nook.
Licences we rely on
Some elements of the site, such as typefaces and icons, are used under licences from their creators. Those licences allow us to use them on giftnook.shop and on our products; they do not give visitors the right to extract and reuse them. The fonts used across the site are open-licence typefaces, and our logo lettering was drawn as outlines from one of them.
